1. Introduction

1.1 Agreement

These Terms of Use (“Agreement”) govern your use of My Digital Business Card (“Service”, or sometimes, “DBC”), the project under the URL https://makemy.contact/. This Agreement is a legally binding contract between you and My Digital Business Card.

1.2 Who Can Use the Service

You must be at least 18 years old or have permission from a parent or guardian to use our Service.

2. User-Submitted Information

2.1 Providing Information

As a user, you may submit personal information including but not limited to your name, job title, contact details, website URL, links to your social profiles, and an image (“User Information”). By submitting this information, you grant us the right to use it to create your web-based Digital Business card and to handle it in accordance with our Privacy Policy.

  • We will NOT use your contact information to send you any advertising or promotional materials whatsoever.
  • We WILL, however, use your contact information to communicate with you about your order AND to send you a payment reminder, if necessary.

2.2 Accuracy of Information

You are responsible for ensuring the accuracy and completeness of the information you submit.

2.3 Updating Information

Removing outdated and adding new information upon your request requires additional time and work, and shall be paid additionally.

2.4 Keeping the Information Available to View

People can retire, die, or stop needing to use the Digital Business Card for multiple other reasons.

Because of this, and also to provide for the web hosting services that we use to keep the makemy.contact platform with your DBC available online, we will apply a token amount of €1 as an annual recurring fee.

This amount shall be paid annually starting from the 2nd year of using your DBC.

Example:

  • You have received the finished and ready-for-use DBC (for which you’ve paid the agreed amount of €65) on 20 October 2023.
  • A year later, before 20 October 2024, after a written reminder, you pay €1 for your DBC to be web-hosted and available online for the period of 20 October 2024 – 19 October 2025. 
  • Another year later, before 20 October 2025, after a written reminder, you pay €1 for your DBC to be web-hosted and available online for the period of 20 October 2025 – 19 October 2025. And so on.
  • If we do not receive from you the recurring amount of  €1, e.g. before 20 October 2030, we assume that you do not want to continue using your DBC, and will stop making it available online.

3. Digital Business Cards

3.1 Creation and Distribution

We will use the provided User Information to create a digital business card (“Business Card”) that you can save to your smartphone and share with others via a pop-up QR code.

  • The business card will be hosted at this website (makemy.contact) and will have the URL-extension showing, upon your choice, EITHER (1) your name (for example: https://makemy.contact/samantha-bricks/, OR (2) your name plus a random string of numbers (for example: https://makemy.contact/samantha-bricks-9480105/,
  • The 2nd option is meant to prevent other people, with whom you do not have the express willingness to share the data, from finding your Business Card contact data.
  • You can then save your personal page with your digital business card to the Home screen of your smartphone for quick and easy sharing.

3.2 Sharing and Downloading

  • To share your Digital Business Card with others, press the Share this Contact/Share via QR Code button, which will trigger the QR code to this Business Card.
  • Any person you’ve shared your Business Card with can share it with others using the provided QR code.
  • They can also choose to add your contact information to their Contacts (Address Book) by pressing the Save to my Contacts button.
  • The link ‘Order Your Own Digital Business Card‘ in the Footer of your business card is always present there.

3.3 Ownership

You retain ownership of the User Information you submit. We have the right to use, display, and distribute the Business Card created from this information.

4. Prohibited Activities

4.1 No Harmful Activities

Please don’t use our Service for any illegal, harmful, or unethical purposes.

4.2 No Spam

Please don’t use our Service to send unsolicited messages.

5. Termination

5.1 Ending the Agreement

You can stop using our Service at any time. We may also terminate your access for violating these terms.

6. Privacy

6.1 Your Privacy

We respect your privacy and will handle your information as described in our Privacy Policy.

6.2 Cookies

Like most websites, we use cookies. You can manage these in your browser settings.

7. Changes to Terms

7.1 Updates

We may update these terms from time to time.

To avoid unsolicited messaging, we will not send you new terms. Instead, we’ll post the updated terms here, indicating the date of the update.

8.1 Communication

The initial contact is effected via completing the submission form on the home page. After that, we will reply to you at the e-mail you’ve provided, so make sure that the e-mail address is correct.

9. Disclaimer of Liability

While we take every precaution to ensure the security and smooth operation of our service, we cannot guarantee that our website will be free from unauthorized access by third parties, or that technical issues beyond our control will not occur. By using our service, you acknowledge and accept the inherent risks associated with online services, including but not limited to the potential for data breaches or disruptions in service due to unforeseen circumstances.

We will make reasonable efforts to promptly address and rectify any technical issues that may arise. However, we disclaim any liability for damages or losses that may result from such incidents.

In the event of a security breach or significant technical issue, we will take all necessary steps to mitigate the impact and inform affected users as soon as practicable.
